Welcome to ehrscape.com ("Service", "EhrScape"), a website operated by Marand ("Us", "We", "Our"), a software company from Ljubljana, Slovenia that is focussed on the development of a platform for structured electronic health records based on latest release of openEHR specifications. EhrScape provides platform services as developed by Marand Ltd for evaluation-only purposes to individuals, groups, organizations and businesses ("you"). This currently includes HTTP REST APIs services, documentation, code examples, but we intend to add other capabilities over time.
By making use of the Service, you agree to the following terms. Please ensure you read them carefully.
Scope of Licence
By accessing this Service, you are agreeing to be bound by these Terms of Service ("Terms"), all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trade mark law. You acknowledge and agree that Marand owns all legal rights, title and interest in the Services we provide as well as all the intellectual property rights. You are given a personal, revocable, non-exclusive and non-assignable licence to use our Services. You may only use the Services at our discretion and any other use is strictly prohibited. Your licence is revocable at any time with or without cause. Unauthorized use is strictly prohibited. Unless you have an agreement with Marand in writing, you are prohibited to use any of our trade names, trademarks, service marks, logos, domains or other distinctive brand features.
You are allowed to print and download from our Services, however you may not modify the printed/downloaded files in any way, use graphics separately from the corresponding text or remove trademark and copyright notices.
User's account, password and security
By using the Services, you guarantee that all account information provided is truthful, accurate, current and complete; you also agree that you will maintain the accuracy of such information. You agree that you will be responsible for maintaining the confidentiality of your password and other account-related sensitive information that allow you to access our Services. You also agree that you will be responsible for all activities that occur under your account. You agree that we will not be held accountable for any unlawful access to or use of our Services by anyone with whom you have shared your access or log-in credentials.
You acknowledge and agree that our Service might occasionally be interrupted and that continuous availability of our Service is not guaranteed.
We will do our best to ensure that our Service is available at all times, however we shall not be held liable if our Service is unavailable at any time or for any period and for any reason. You acknowledge and agree that if we disable your account, you will be prevented from using the Services we provide, your account details and the content contained in your account. Access to your account will be disabled in case you violate these Terms or when your actions might be potentially disrupting the operation of our Services.
No Third Party Access
You will not resell, sublicense, lease, time share or otherwise make our Services, or parts thereof, available to third parties.
You will also not send or store infringing or unlawful information using our Services. You will also not attempt to gain unauthorised access to the Services or disrupt the integrity or performance of the Services or the data they contain.
There are no third party beneficiaries under these Terms.
EhrScape does not give medical advice. Our Services enable the development of healthcare related applications and may consequently help with medical decision-making, but are under no circumstances intended to provide medical advice, diagnosis, treatment or to substitute professional judgement. Information given through the Services is for informational and educational purposes only.
You assume full risk and responsibility for the use of information you obtain through our Services.
Our Services should not be used in case of a medical emergency.
Except as expressly provided in section Scope of Licence and as allowed by applicable laws, you may not copy, decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Service.
You will not propagate any virus, worm, Trojan horse or other malware or technically harmful content intended to damage any system or data to or from the Services we provide.
You will not use the Services in any manner that violates any data protection statute, regulation, order or similar law.

You warrant that you have obtained proper consents, authorisations or releases from individuals to the fullest extent required by applicable laws before sharing any of that information using these Services.

To the extent permitted by law, the total liability of Marand Ltd for any claim under these terms, including for any implied warranties, is limited to the amount paid in the past year of usage of the service.
Governing Law and Jurisdiction
These Terms are governed and interpreted in accordance with the laws of Republic of Slovenia. You consent to the exclusive use of jurisdiction of the Republic of Slovenia for resolution of any disputes that arise from these Terms.
